'Doedd 2105 ddim yn rhyw flwyddyn ble mae'n bosib edrych yn ol fel un iw chlodfori rhywsut - Mi aeth allan gyda tipyn o siomedigaeth inni oll drwy unwaith eto weld Brwnwr yr Uchel Lys Mr Ustus Hickinbottom yn gwrthod ein cais i Cyfoeth Naturiol Cymru ail ystyried ei penderfyniad fod llygredd Llyn Padarn ddim i wneud a dirywiad y torgoch. Fel 'rwyn gweld y sefyllfa mae hyn yn rhoi pob safle gwyddonol arbenig (SSSI) mewn perygyl, gan yn ol pob golwg nid yw llywodraeth Cymru wedi mabwysiadu deddfau Ewrop sy'n gwarchod safleoedd or fath.
Mae Fish Legal o'r farn fod y dyfarniad yma gyda oblygiadau pellgyrheaddol tuag at warchod ag amddifyn ein hamgylchedd. Cymaint yw'r pryder mi ofynwyd i'r barnwr am yr hawl i apelio yn erbyn ei benderfyniadau - wrth gwrs gwrthodaodd y cais. Y broses wedyn oedd cyflwyno sail ein apel i'r Llys Apel yn LLundain. Mae hyn wedi ei wneud, felly rhaid disgwyl unwaith eto am sylwadau'r llys.
Fy hun - nid oeddwn wedi fy synnu gyda'r penderfyniad yn dilyn gwrando ar y cyflwyniadau cyfreithiol yn y llys yng Nghaernarfon, gan ein bod ni - fel cymdeithas fechan wedi meiddio herio grym Cyfoeth Naturiol Cymru, ei meistri sef Llywodraeth Cymru a cwmni Dwr Cymru/Welsh Water. Cawn weld efallai bydd y llys apel yn fwy agored yn ei meddylfryd.
Nid yw penderfyniadau Cyfoeth Naturiol Cymru ddim yn mynd i lawr y dda iawn yng nghefn gwlad, oherwydd diffyg mawr y corff yma i wrando a cymryd sylw ar bryderon lleol sy'n ymwneud a'n pysgodfeydd. Mae nifer o gyfrafodydd wedi bod dros y misoedd diwethaff gyda'r bwriad yn ol pob golwg o ddod a deddf i fodolaeth fydd yn gorfodi 'Catch and Release' gyda'r eog ac o bosib y sewin hefyd. Mae gryn ofid yn ein cymunedau gweldig fod y corff yma yn edrych yn debyg ei fod eisaiau atal pyagota'n gyfan gwbwl am y ddau 'sgodyn hyfryd yma. Oes mae dirywiad wedi bod yn nifer yr eog - ond yn anffodus does neb mewn awdurdod yn fodlon cyfaddef na gwrando chwaith ar be yw gwreiddyn y broblem - Wel dyma be sy'n bod yn y fro yma o leiaf - llygredd, effaith diwidiant (cynhyrchu trydan) ymarfer amaethyddiaeth, coedwigaeth, potsio a gor pysgota ar y moroedd. Yn anffodus does dim ewyllys i ddelio ar materion yma - felly atal pysgota ac ymhen rhyw ychydig flynyddoedd fydd neb yn cymryd sylw na diddordeb yng nglendid ein dyfreodd, nes wrth gwrs ei bydd rhyw hwyr, a bydd pawb yn boddi yng ngharthion ein hunain.
'Rwyn wir gobeithio y bydd holl egni'r gymdeithas yn ystod 2016 yn cael ei anelu at geisio cael Cyfoeth Naturiol Cymru i wrando a gweithredu ar bryderon lleol. Mae yma'r wybodaeth ar arbernigrwydd i pawb gyd-weithio er bydd ein hamgylchedd. Gan ar ddiwedd y dydd does ddim eisiau i'r genhedlaeth sy'n ein dilyn fod yn feirniadol o be 'rydym ni yn adael iddynt fel etifeddiaeth.
Hwyl Fawr ac edrych ymlaen am be a ddaw yn ystod 2016.

2015 turned out to be a year where we could look back upon with very much satisfaction, especially considering that our application for a Judicial Review at Caernarfon Court before Mr. Justice Hickinbottom was refused. This decision confirms Natural Resources Wales decision in that the Padarn Lake pollution was not responsible for the decline in charr numbers. This decision is likely has far reaching implications on SSSI's throughout Wales at least.
Fish Legal's opinion is that the implications surrounding this decision could have serious consequences for our environment and as such requested leave to appeal - this was also refused. Following this an appeal has now been lodged with the Court of Appeal in London. We await their reply.
Personally after listening to the presentations at the court I really wasn't that surprised by the outcome - as we as a small society had taken on the might of Natural Resources Wales and their masters at the Welsh Government and Welsh Water. Perhaps the justices at the court of appeal might be more in tune with what's going on.
Natural Resources Wales's decisions are not at all appreciated by our rural communities - especially those who appreciate that fishing brings much needed economic benefit in its wake. The latest matter under review and has been the subject of several meeting throughout Wales has been on the emotive subject of 'catch and release' for salmon and probably sea trout as well. We all appreciate that there has been a dramatic decline in salmon numbers but the sad part is that the authorities fail to address the real cause of the decline - in this area it's Hydro Power, pollution, agricultural practices, forestry, poaching and over fishing at sea. If these matters were given the attention they deserve than things would surely improve. We all feel that the only direction NRW and their cohorts would like to follow, would be to see fishing completely prohibited. Then in a few years there would be nobody left to look after and take an interest in what's affecting our waters. This would prevail until it's too late and by then we will all be drowning in our own effluent. By the time this takes place those responsible for today's decisions will have long disappeared over the horizon.
Despite all the negativity that's about the place - we all look forward for a positive 2016 and hope to direct all the societies energy to try and get Natural Resources Wales to listen and act on our local concerns. We have all the information and expertise, we should all work together for the benefit of our environment. After all we do not wish to leave a legacy, so that those who come after us will condemn us for the mess we left.
