Rhwng 24 a 25 Tachwedd bu gwrandawiad cais y gymdeithas am Adolygiad Barnwrol ar benderfyniad ymchwyliad Cyfoeth Naturiol Cymru i lygredd Llyn Padarn ar effaith ar y torgoch. 'Roedd barn CNC yn ei ymchwilaid yn dweud fod yr holl lygredd heb gael dim effaith ar gynefin na iechyd poblogaeth y pysgodyn prin yma.

'Does dim achos fel hyn wedi bod o fewn y llysoedd newydd yng Nghaernarfon, ond 'roedd yn amlwg pwy sy'n gyrru'r gwrthwynebiad i'r cais - sef Llywodreath Cymru. Nid yw'n deg imi fynd ymhellach ar hyn oherwydd fod y barnwer Mr. Ustus Hickinbottom heb ryddhau ei ddyfarniad. Gobeithio bydd hyn i law cyn y nadolig.

                                                    ----------------------------------------------

Between 24 and 25th. November the societies Judicial Review application at Caernarfon Justice Centre before Mr Justice Hickenbottom took place.  The thrust of this application was to challenge National Resources Wales's decision that Padarn Lake's pollution had no detrimental effect on the charr population.

Being present at the hearing it was obvious that the Welsh Government was the body driving the opposition to our application. However as a decision is awaited - hopefully before christmas I'll refrain from further comment.

Gyda problemau Llyn Padarn yn cael effaith ar y torgoch, a stocio yn gorfod cyfmryd lle i geisio achub y boblogaeth( stocio heddiw lluniau eto ar y galeri prynhawn 'ma). Mae'n aelodau wedi symud i bysgota Llyn Cwellyn ble mae'r pysgodyn hardd yma ddim yn cael ei effeithio gan lygredd .

Yma mae'r pysgota yn ardderchog gyda'r torgoch yn ei maint naturiol - sef rhyw dri meu bedwar i'r pwys. Hen ddywediad yn Llanbris cyn y problemau medda Closs - ia dwi'n mynd yn ol i'r 1960's oedd - i wneud pwys mi oedd eisiau tri torgoch a ceiniog, ia cofiwch hen geiniog i'r rhai sy'n cofio.

Cawn weld be fydd dyfodol pysgotfa Padarn a'r Seiont gan fod ein achos drwy Fish Legal  yn yr Uchel Lys at ddiwedd Tachwedd eleni - yng Nghaerdydd dwi'n credu fydd y gwrandawiad.

Diolch i Matt Perring am anfon llun torgoch o'r Cwellyn  -gweler yn y galeri.

                                                      ------------------------------

With Padarn's problems taking it's toll on the charr and artificial stocking taking place (this afternoon - photos on the Galery later on today) to try and revive the population. Members have turned to Cwellyn wich is unaffected  by problems and the charr are in their natural size. The old saying, so say's Closs, that during 1960's in Llanberis was that to make a pound weight it takes three charr and a penny, an old penny to those who remember.

The fishing is good on Cwellyn and thanks to Matt Perring for a shot of a Cwellyn Charr - that's how they should be. (Photo on Galery)

We'll soon see how things are to develop on Padarn as the High Court hearing  taken by Fish Legal against natural resources wales and Welsh Gov. Ministers is scheduled for the end of this month - at Cardiff I believe.

Mae'r Llyfni yn llawn o Wyniadau/sewin - defnyddio gwyniadau gan na dyma'r enw lleol, term go ddiweddar yw sewin yn y fro hon.

'Rwyn teimlo ei bod yn eithriadol o bwysig I gadw a defnyddio'r hen enwau lleol, un o'r goreu yn fy nhyb yw Llyn Llam Dda ar y Gwyrfai, dyma ble gafodd Tomos Morgan, Waenfawr ei eog yn gynharach y mis - un da oedd hefyd am 8bwys.

Ma'e holl dyfroedd heblaw Seiont a Padarn yn 'sgota'n eithriadol o dda. mae'r eogiaid ac yn enwedig y gwyniadau ar gynnydd.

Mae gweithdy yng Nghaerdydd ar 2/9. i drafod penderfynisd Cyfoeth Naturiol Cymru i atal stocio a cau deorfeydd Cymru . Am y tro cyntaf 'rwyn trio'r gwasanaeth hedfan o Sir Fon.   Cychwyn am 8.55 a byddaf yn y cyfarfod yng nghanol y ddinas am 10.30 - da de! ar cwbwl gyda tacsi am £150. At last salmon have started showing in the Straits by the 'Dead Man' buoy -a good sign that they are destined for the Seiont. One at least at 8lbs has made to fall to the rod of Malcolm Owen, Caernarfon.

The Llyfni is full of sea trout and the Gwyrfai also has had a run of salmon - and a nice of 8lbs  came earlier in the month to Tomos Morgan, Waenfawr from Llyn Llan Dda - there is no inspirational translation to these wonderful old names and all should make the effort to use them - I'll task the lingusist's amongst you to translate in keeping with the original meaning.

All our water except the Seiont and Padarn have been fishing really well this year and both salmon and sea trout runs are improving.

2/9 sees a workshop being held in Cardiff to discuss Natural Resources Wales's decision to stop all stocking and close hatcheries in Wales. I'm trying the air service from Anglesey for the first time - 8.55am from Valley and I'll be in central Cardiff by 10.30 - flight taxi &all for £150 - I'll be home by 6.30pm. Train would take 4.30hrs each way and driving about 5 hours each way with hotel and beer to boot. We'll see how it goes

Can everybody please note that this years Youth Fly-fishing Trials
to choose a team for 2016 will now be >held at Llandegfedd Reservoir on Sunday 6th September.

The entry fees to enter the trials have been significantly reduced and
the details of which, together with the new entry forms can soon be
found and downloaded off the WSTAA web site.

It is strongly requested that all clubs and individuals make a big
effort to encourage, develop and persuade as many
youths as possible within their clubs or associations to enter the
trials and ‘have a go’ and see what they could be missing.

A number of you are known to have a core of Junior anglers and we are
aware of one club who have taken the initiative and
have at least six junior anglers undergoing individual private
instruction as a preparation for possible entry into international
competitions. It would be great if others could also have the same
foresight and be inspired to do the same.

If any problems are experienced in downloading entry forms, Please
contact me.

Many Thanks

Newyddion da  fydd yn galluogi Fish Legal a chyrff pysgota, ymysg eraill, gael y gwir am lygredd yn ein afonydd.
Good news that will allow fish legal and angling bodies gain access to the true situation when pollution incidents are suspected.

http://www.fishlegal.net/default.asp

The environmental and angling organisation, Fish Legal, has won a major victory in a groundbreaking case against Yorkshire Water Services Ltd and United Utilities Plc, which was the culmination of a six year legal campaign for greater transparency within the water and sewerage industry.
The Upper Tribunal has ruled that water companies in England & Wales are ‘public authorities’ for the purposes of the Environmental Information Regulations (2004) and so are under a legal duty to disclose environmental information they hold to the public.
The implications of this test case, which has been fought over the past 6 years, will be felt industry-wide. It could also affect companies operating in other privatised industries which have a similar role managing resources and services of public interest, such as the oil, gas, electricity providers and the Royal Mail.
Fish Legal often wants to know about sewage pollution and over-abstraction that damages rivers and coastal waters to help it fight legal cases on behalf of its member clubs and fishery owners. This judgment means it now has a right to get this information directly from the water companies themselves. In the past, several companies refused to provide any information when asked, whilst others expressly refused to disclose information in line with this law. The Judges in this case ruled they were wrong to do so.

This new right will benefit other environmental and campaigning groups affected by sewage pollution such as Surfers Against Sewage, or those with a wider environment remit, such as WWF, RSPB and river trusts. Any concerned individual or organisation now has a right to the environmental information held by the water and sewerage companies.
The water and sewerage industry causes significant damage to the environment every year. This is partly due to the very nature of what it does in treating sewage and abstracting water, but in many cases is due to mismanagement and underreporting of incidents. The industry will now have to open up what it does to much greater public scrutiny.
William Rundle, Head Solicitor at Fish Legal, said:
“We are delighted with this result, which has at long last asserted the rights of our angling members, and the wider public, to get information from these companies when they cause pollution or other damage. Being able to obtain environmental information directly about activities that affect the environment will make it much easier to deal with complex issues affecting fisheries. We sincerely hope that with the industry’s greater accountability will come higher environmental performance.”
Mark Lloyd, Chief Executive of the Angling Trust & Fish Legal said:
“This is a huge victory for the environment and for fish and fishing. Our legal team at Fish Legal has done a brilliant job fighting this case over the past 6 years, taking on some of the largest companies in the country and winning. This has only been possible because of the support of members of the Angling Trust & Fish Legal, whose subscriptions enable us to fight these battles for the benefit of all anglers and the water environment. Once again, we have demonstrated that when anglers unite, we can be a very powerful force for good.”

Llyn Padarn

Cyhoeddwyd canlyniad ail archwiliad Cyfoeth Naturiol Cymru i lygredd Padarn, am yr eilwaith. Mae'r corf yn dweud er fod Dwr Cymry/Welsh Water wedi llygru dyfroedd y llyn ond nid yw hynny wedi cael unrhyw effaith ar broblemau'r torgoch. Hefyd maen't yn dweud am yr ail dro fod gorsaf Bwer Dinorwig sydd wedi amddifadu'r torgoch o Lyn Paris a'i afonydd claddu - nid yw hyn chwaith  yn cael effaith negyddol.  Er fod hyn yn hollol glir i pawb.

Mae Fish Legal eto yn edrych ar ddychwelyd i'r llysoedd i geisio cael corf amgylcheddol Cymru ddod i'r penderfyniadau cywir.

Gresyn meddwl fod corf fel hyn yn gallu trin ein amgylchedd mor ysgafn, wrth feddwl na ei meisteri iw LLywodreth Cymru yng Nghaerdydd - amser i rhain daflu i ffwrdd y lleni sy'n gorchuddio be sy'n amlwg.

                                           ---------------------------------------------------

Natural Resources Wales have released the result of their second investigation into the Padarn pollution. They state that Dwr Cymru/Welsh Water were responsible for polluting the lake's water but this did not have a negative effect on the charr population. They also say and for the second time that the Dinorwig Power Station which cut off the whole of Lake Peris and a majority of the charr's spawning rivers, this again does not have any effect on their well being. Although of course we all know different.

Fish Legal are now looking to return to the courts in an attempt to for NRW to re-consider their flawed decisions for the second time.

It's a sorry state when a public body such as NRW which is responsible for our environment treat's their responsibilities so lightly. This when their masters are the Government of Wales, it's about time that they throw off their blinkered view is what's obvious to all.
